Terms of Service

These Terms of Service ("Terms") govern access to and use of PwaNow ("PwaNow," "we," "us," or "our"), a hosting service for static sites and Progressive Web Apps operated at pwanow.com and its subdomains (the "Service"). By creating an account, uploading a site, or otherwise using the Service, you ("you," "Customer") agree to these Terms. If you're using the Service on behalf of an organization, you're agreeing on that organization's behalf and confirming you have authority to do so.

1. The Service

PwaNow lets you upload a static site or PWA build and serve it from a subdomain of pwanow.com, or from your own custom domain on paid plans, with TLS, PWA-correct headers, and SPA routing configured automatically. Access is available through the dashboard, API keys, and a hosted MCP server for AI-agent-driven workflows.

2. Accounts

You must provide a valid email address and keep your account credentials confidential. You're responsible for all activity under your account, including activity performed through API keys or MCP connections you create. Tell us promptly if you believe your account or an API key has been compromised. We may require reasonable steps to verify your identity or ownership of an account.

3. Acceptable Use

You may not use the Service to host, transmit, or distribute content or traffic that:

  • Is illegal in the jurisdictions where you or PwaNow operate, or infringes someone else's intellectual property, privacy, or other legal rights;
  • Contains malware, phishing pages, or content designed to compromise a visitor's device or credentials;
  • Is used to launch, coordinate, or support attacks against other systems (denial-of-service, credential stuffing, port scanning, spam, and similar activity);
  • Materially misrepresents its origin (impersonating another person, brand, or organization) in a way intended to deceive;
  • Attempts to circumvent plan limits (site count, storage, or data transfer allowances) through automation, abuse of the API, or technical workarounds rather than upgrading to a plan that fits your usage; or

We may investigate suspected violations and take action - including content removal, suspension, or termination - as described in Section 8, with or without notice where we reasonably believe notice would increase risk of harm.

4. Your Content

You retain ownership of the site files, code, and other content you upload ("Your Content"). You grant PwaNow a limited, non-exclusive, worldwide license to host, store, cache, copy, and serve Your Content solely as necessary to operate and provide the Service. You're solely responsible for Your Content and for having the rights necessary to upload and distribute it.

If you believe content hosted on the Service infringes your copyright, send a notice to vanmeyconsulting@gmail.com identifying the material and your good-faith basis for the claim, and we'll respond in accordance with applicable law, which may include removing or disabling access to the material.

5. Plans, Fees, and Billing

The Service is offered under Free, Pro, and Business plans, each with its own site count, storage, and data transfer allowance as described in Section 6 and on our Pricing page. We may introduce, modify, or retire plans, and may change fees, with reasonable advance notice for existing paid subscriptions (posted on our Pricing page or sent to your account email).

Paid plans are billed in advance on a recurring basis until canceled. Payment processing, invoicing, and (where applicable) sales tax/VAT collection are handled by Paddle.com, our payment provider and merchant of record for these transactions - your purchase is subject to Paddle's own buyer terms in addition to these Terms. You authorize Paddle to charge your payment method for subscription fees and any data-transfer overage charges you've opted into under Section 6. Fees are non-refundable except where required by law or stated otherwise at the time of purchase.

If a payment fails, your account may enter a grace period during which existing sites keep serving but plan-upgrade actions are blocked, followed by downgrade to the Free plan's limits if the payment issue isn't resolved.

6. Data Transfer Allowance and Overage

Each plan includes a monthly data transfer (bandwidth) allowance, metered across all sites on your account and reset at the start of each calendar-month billing period. Current allowances are published on our Pricing page and, as of this writing, are approximately 5 GB/month (Free), 200 GB/month (Pro), and 2 TB/month (Business).

Default behavior - suspension. If your account reaches its plan's data transfer allowance for the current billing period, your sites will temporarily stop serving traffic to visitors (returning a notice page instead) until the next billing period begins, or until you upgrade to a plan with a higher allowance, whichever happens first. This is automatic and does not require action from us.

Optional overage billing. You may opt in, from your account's Billing page, to be billed for data transfer overage instead of having your sites suspended. If you've opted in, your sites continue serving traffic past your plan's allowance, and at the close of the billing period we'll charge your payment method on file for the data transferred beyond your allowance, currently at $20 per 100 GB block (or part thereof) over your allowance (subject to change with notice, as with other fees under Section 5). You can turn this off at any time for future billing periods; turning it off does not affect overage already accrued for the current period.

Repeated or sustained use that we reasonably determine is abusive, automated, or not representative of genuine visitor traffic to your site is not covered by these allowance mechanics and may instead be treated as a violation of Section 3.

7. Storage and Other Plan Limits

Plans also include a site count limit and a total storage limit across your sites, both published on our Pricing page. Attempting to create a site or upload content beyond your plan's limits will be blocked until you remove content, delete sites, or upgrade.

8. Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, if: you violate Section 3 or these Terms generally; your account is past due on payment beyond any applicable grace period; your account reaches its data transfer allowance under Section 6 and you haven't opted into overage billing; or we reasonably believe suspension is necessary to prevent harm to the Service, other customers, or third parties. Where practical, we'll try to give you notice and an opportunity to resolve the issue first.

You may cancel your account or downgrade your plan at any time from the dashboard or billing portal. Upon termination, we may delete Your Content after a reasonable period; you're responsible for exporting anything you want to keep before canceling.

9. Service Availability

We aim to keep the Service reliably available but don't currently guarantee a specific uptime percentage or service level, and the Service is provided on an "as available" basis. We may perform maintenance, and infrastructure providers we rely on (including AWS and Paddle) may themselves have outages outside our control.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or secure against all forms of unauthorized access.

11. Limitation of Liability

To the maximum extent permitted by law, PwaNow won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose, or $100 if you're on the Free plan. Some jurisdictions don't allow these limitations, so some of the above may not apply to you.

12. Indemnification

You'll indemnify and hold PwaNow harmless from claims, damages, and reasonable expenses (including attorneys' fees) arising from Your Content, your violation of these Terms, or your violation of applicable law, except to the extent caused by our own breach of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we'll post the updated Terms here with a new "Last updated" date and, where practical, notify active account holders by email. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws principles, and any dispute not otherwise resolved will be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and PwaNow regarding the Service, alongside any plan-specific terms referenced on our Pricing page.
